FMC Collects $1.9 Million Civil Penalty from Maersk Over Shipping Act Violations
The Federal Maritime Commission (FMC) has reached a settlement with Maersk A/S over alleged violations of the U.S. Shipping Act. The agreement includes a $1.9 million civil penalty tied to detention charges assessed against third parties not bound by Maersk’s service contracts or tariff terms.

As part of the settlement, Maersk agreed to revise its U.S. tariff rules, stop the disputed practice, and provide refunds and waivers to affected parties. The company did not admit wrongdoing but agreed to future compliance measures.

The FMC noted that all penalty payments are deposited into the U.S. General Fund, with no portion retained by the Commission.
